Greene County district court, week ending Oct. 6

In Greene County district court Brandon Lee Ferguson, 24, of Jefferson was sentenced Oct. 6 to one year in jail after he changed his plea to guilty to a charge of possession of methamphetamine- second offense. The jail term was suspended and he was placed on probation for one year to Boone/Greene County Probation. He was fined $430 with a $64.50 surcharge. Ferguson was sentenced to 30 days in jail on a charge of false information for citation for indictable offense. He was fined $105 with a $15.75 surcharge. The jail time and fine/surcharge were suspended. He was also sentenced to 10 days in jail on a charge of driving while license barred. He will serve that jail time. He was fined $855 with a $128.25 surcharge; the fine and surcharge were suspended. Ferguson must pay $125.40 restitution for his court appointed attorney’s fees and $100 court costs. Jesse James Sanders, 20, of Churdan was sentenced to 10 days in jail with credit for time served after he changed his plea to guilty to a charge of driving while license barred. He was fined $855 with a $128.25 surcharge; both were suspended. He must pay $119.16 court costs. (Sentencing: McCarville)

Michael Keith Thompson, 34, of Jefferson was sentenced to four days in jail with credit for time served after he changed his plea to guilty to a charge of driving while license revoked. The jail sentence was suspended and he was placed on probation for one year to Boone/Greene County Probation. He was fined $1,000 with a $150 surcharge. He must pay an amount not to exceed $600 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)

Ethan Michael Hueser, 20, of Fort Dodge was granted a deferred judgment after he changed his plea to guilty to a charge of possession of marijuana. He was placed on informal probation to the Greene County sheriff for one year. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. He must pay a $430 civil penalty and $136.50 court costs. A charge against Hueser in magistrate court of possession of drug paraphernalia was dismissed. He must pay $95 court costs in that case. Merissa Shawnay Olson, 32, of Jefferson was granted a deferred judgment after she pleaded guilty to a charge of harassment- second degree, amended from harassment- first degree. She was placed on informal probation for one year to Boone/Greene County Probation. She must undergo a substance abuse evaluation and complete any recommended treatment at her own expense. She must also undergo a mental health evaluation and follow through with any recommended treatment. A judgment was entered for a $430 civil penalty, $600 restitution for her court appointed attorney’s fees and $131.50 court costs. (Sentencing: McCarville)

Saw Joy, 34, of Perry was sentenced to one year in jail after he changed his plea to guilty to a charge of operating while intoxicated. All but two days of the jail time was suspended and he was placed on probation for one year to Boone/Greene County Probation. He must undergo a substance abuse evaluation and complete any recommended treatment at his own expense. Joy was fined $1,250 with a $187.50 surcharge. He must pay $600 restitution for his court appointed attorney’s fees and $385 court costs. (Sentencing: McCarville)

Tracy William McDonald, 46, of Jefferson was sentenced to 10 four days after he pleaded to guilty to a charge of assault- simple, amended from domestic abuse assault impeded blood/air flow. The jail term was suspended. He was fined $105 with a $15.75 surcharge. He must pay an amount not to exceed $600 restitution for his court appointed attorney’s fees and $171 court costs. Rick Eugene Tuhn, 42, of Grand Junction was sentenced to 14 days in jail with credit for time served after he changed his plea to guilty to a charge of driving while license barred. The jail term is consecutive to the term in a Greene County felony case. He was fined $855 with a $128.25 surcharge; both were suspended. He must pay an amount not to exceed $600 restitution for his court appointed attorney’s fees and $100 court costs. (Sentencing: McCarville)

Ian Russell Patterson, 42, of Des Moines was sentenced to five years in prison after he changed his plea to guilty to a charge of eluding causing injury, under the influence of alcohol or drugs or participating in a felony. The prison term was suspended and he was placed on probation to the Department of Corrections for two years. He was fined $1,025 with a $153.75 surcharge. He was sentenced to 30 days in jail with for time served on a charge of possession of marijuana- second offense. He must pay an amount not to exceed $1,000 restitution for his court appointed attorney’s fees. (Sentencing: McCarville)

Sean Patrick Shell, 46, of Jefferson was sentenced to 30 days in jail, concurrent to a sentence in another Greene County case, after he pleaded guilty to a charge of possession of marijuana- first offense, amended from possession of marijuana- second offense. He was fined $430 with a $64.30 surcharge. The court found him unable to pay restitution for his court appointed attorney’s fees or court costs. A charge of possession of methamphetamine was dismissed, as was a charge in magistrate court of possession of drug paraphernalia.

Persons pleaded not guilty to charges in district court as follows: Robert E. Barnard Jr, 56, of Des Moines, dominion/control of firearm/offensive weapon by felon, dominion/control of firearm by domestic abuse offender, possession of marijuana; Jerry Dean Barker, 58, of Grand Junction, possession of controlled substance, possession of methamphetamine, failure to affix tax stamp, and possession of marijuana- second offense; Lawrence Shannon O’Neal, 47, of Grand Junction, driving while license barred; Benjamin Harold Winborne, 32, of Churdan, driving while license barred; and Alejandro Flores, 29, of Des Moines, operating while intoxicated- second offense. Trial date was set for Nov. 1 for Barker, and for Dec. 13 for Barnard, O’Neal, Winborne and Flores.

Cases were initiated as follows: Jacob Allen Wayne Roop, 26, of Marshalltown, theft- first degree, theft- second degree, and criminal mischief- second degree; and Sirjohn Daniels Wilder, 38, of Jefferson, harassment- second degree.
